Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Burgess Outdoor Adventures, LLC, an Illinois limited liability company doing business as Fishwego ("Fishwego," "we," "us," or "our"). The Terms govern your access to and use of the website located at fishwego.com, any related subdomains, and any services we provide through it (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least eighteen (18) years old to use the Service or to book a trip. By using the Service, you represent that you meet this requirement and that you have the legal authority to enter into this agreement. If you are booking on behalf of a group, you represent that you are authorized to act on behalf of every member of that group with respect to bookings, payments, and communications with the camp.
2. About Fishwego
Fishwego is an online booking platform that helps travelers discover and book stays at independently-operated fishing camps and outfitters ("Camps"). Fishwego is not the operator of any Camp, does not own or manage any cabin, boat, meal service, or guided trip, and is not the provider of any service you book through the Service.
When you book a trip through Fishwego, you are entering into a separate agreement with the Camp for the services that Camp provides. Each Camp is an independent business responsible for the quality, safety, accuracy, and delivery of its own services.
Fishwego's role is limited to:
- providing a platform to discover Camps and their offerings,
- facilitating the booking process,
- collecting and remitting payments through our payment processor,
- providing customer-support coordination, and
- maintaining the records of your booking.
3. Your Account
You may need to create a Fishwego account to save trips, complete a booking, or make payments. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@fishwego.com if you suspect unauthorized use.
Accounts may be created automatically the first time you save a trip ("Lazy Account"). By saving a trip, you authorize us to create an account associated with the email address you provide and to send you a magic-link sign-in. You may set a password and complete your account at any time.
You agree to provide accurate, current, and complete information when creating or updating your account.
4. Bookings and Payments
4.1 Booking Process
You build a trip on the Service, select dates and inventory at a Camp, and submit it for confirmation. The booking becomes effective when (a) the Camp's deposit threshold has been met (per Section 4.3 below) and (b) Fishwego confirms availability and issues a booking confirmation. Until both conditions are met, your selections constitute a request, not a confirmed reservation.
4.2 All-In Pricing
Fishwego displays all-in pricing on the Service. The price you see for any item — a cabin, a boat, a meal plan, an extra, or your complete trip — is the total amount you will be charged for that item. No additional fees, taxes, or surcharges are added at checkout.
The displayed all-in price includes:
- the Camp's charge for the items you have selected,
- any applicable taxes,
- any Fishwego service fee, and
- any payment-processing costs.
Your receipt may itemize these components for your records, but the all-in price displayed before checkout is the only amount Fishwego or our payment processor is authorized to charge to your payment method for the items you have booked. Prices are stated in U.S. dollars unless otherwise indicated.
In-person purchases at a Camp (incidentals, gratuities to guides, food and beverage purchases at the Camp, etc.) are not part of your Fishwego booking and are paid directly to the Camp.
4.3 Deposits and Balance Payments
Most bookings require a non-refundable or partially-refundable deposit to confirm. The deposit amount is a percentage of the trip total set by the Camp (platform default: 25%). The remaining balance is due according to the Camp's policy and is typically required thirty (30) days before check-in.
By providing payment information, you authorize Fishwego and our payment processor to charge your selected payment method for the deposit at the time of booking and, where you have opted in or where required by the Camp's policy, to automatically charge your payment method for the balance and any selected installments in advance of the balance-due date. You may opt into an installment plan (single, monthly, or quarterly) where one fits the time between deposit and balance-due date.
If you select a group payment arrangement (multiple payors splitting a single trip), each payor authorizes charges only for the amounts they have agreed to pay. Fishwego maintains a per-person ledger of who has paid what.
4.4 Payment Processing
All payments are processed by Stripe, Inc. Fishwego does not store your full payment-card information. Your use of payment functionality is also subject to Stripe's terms and privacy policy. You agree that Stripe may obtain and verify information about you as required to process payments.
4.5 Failed Payments
If a scheduled payment fails (declined card, expired card, insufficient funds, etc.), Fishwego will attempt to recharge the payment method on file at intervals of one (1), three (3), and seven (7) days following the failure. If all attempts fail, the affected booking may be modified, reassigned, or cancelled at the organizer's or the Camp's election under the applicable cancellation policy.
5. Cancellations and Refunds
Cancellation and refund terms are set by each Camp and displayed before booking. Fishwego enforces those terms and processes refunds on the Camp's behalf when due. The complete policy is in the Refund and Cancellation Policy, which is incorporated into these Terms by reference.
6. Your Conduct
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law,
- impersonate any person or misrepresent your affiliation with any person or entity,
- harass, threaten, or defraud any Camp, Fishwego employee, or other user,
- circumvent the booking flow to avoid completing payment for a confirmed booking,
- attempt to gain unauthorized access to any part of the Service,
- introduce viruses, malware, or other harmful code,
- scrape, crawl, or use automated means to access the Service except as permitted by our robots.txt, or
- resell or commercialize access to the Service without our written permission.
We may suspend or terminate your account at any time for any violation of this section.
7. Camp Relationships and Responsibilities
While each Camp is an independent business, Camps that participate in the Service have agreed to:
- accurately describe their inventory, pricing, and policies on the Service,
- honor confirmed bookings,
- communicate with guests through the channels Fishwego provides, and
- comply with applicable laws and licensing requirements for their operations.
Fishwego is not responsible for a Camp's failure to meet these commitments. If a Camp fails to deliver on a confirmed booking, contact us at support@fishwego.com and we will help facilitate a resolution, which may include a refund under the Refund and Cancellation Policy.
8. Intellectual Property
The Service, including all text, graphics, logos, and software, is the property of Fishwego or its licensors and is protected by U.S. and international intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. We grant you a limited, non-exclusive, non-transferable license to use the Service for the purpose of researching and booking trips.
Camps retain ownership of their own content (photos, descriptions, etc.) and grant Fishwego a license to display that content on the Service.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FISHWEGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Fishwego does not warrant the accuracy, completeness, or currency of any Camp listing, price, or availability statement. Fishwego does not warrant the quality, safety, or legality of any service provided by a Camp. Fishwego does not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FISHWEGO, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FISHWEGO SERVICE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Fishwego, its officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any Camp, or (d) any content you submit to the Service.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois without regard to its conflict-of-law provisions.
12.1 Informal Resolution
Before filing any formal proceeding, you agree to first contact us at support@fishwego.com and attempt in good faith to resolve the dispute informally. We will respond within thirty (30) days.
12.2 Binding Arbitration
If we cannot resolve a dispute informally, you and Fishwego agree that any dispute arising out of or related to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Peoria, Illinois, or by telephone or videoconference at the consumer's election. The arbitrator's decision is final and binding.
12.3 Small-Claims Carve-Out
Either party may bring a qualifying claim in small-claims court instead of arbitration, provided the claim is within that court's jurisdictional limits (generally claims under $10,000) and remains in that court (no removal or appeal to a higher court).
12.4 Class Action Waiver
You and Fishwego agree to bring claims against each other only in your or our individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
12.5 30-Day Opt-Out
You may opt out of arbitration and the class-action waiver by sending a written notice within thirty (30) days of first accepting these Terms to support@fishwego.com with the subject line "Arbitration Opt-Out." The notice must include your name, email, and a clear statement that you opt out. Opting out does not affect any other provision of these Terms.
13. Modifications
We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date above. Material changes are effective thirty (30) days after posting, unless they relate to a new feature or are required by law, in which case they are effective immediately. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
14. Termination
You may close your account at any time by contacting support@fishwego.com. We may suspend or terminate your account at our discretion for violation of these Terms, suspected fraud, or as required by law. Termination does not affect any pending bookings, which remain subject to these Terms and the applicable cancellation policy.
15. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and the Refund and Cancellation Policy, constitute the entire agreement between you and Fishwego regarding the Service.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Notices. Notices to Fishwego must be sent to support@fishwego.com or to 1090 Upper Spring Bay Road, Peoria, IL 61611. Notices to you may be sent to the email address associated with your account.
Force Majeure. Neither party is liable for any failure to perform that is caused by an event beyond that party's reasonable control, including natural disaster, weather, war, civil unrest, government action, or pandemic.
